Joshua Cook is a reporter with BenSwann.com and a resident of South Carolina. Cook recently was given evidence from parents of an 8th grade student that exposed a teacher changing the student’s answers on a quiz. The question asked if a cop could confiscate a gun owner’s gun even though the owner had the proper licence. According to the parents, the student marked “no”, and the teacher told the student the correct answer was “yes”.  (PICTURE)

The post went viral. It has been viewed more than 100,000 times on the site alone and has been picked up by multiple websites in less than 2 days. Though the issue is more of a Fourth and Fifth Amendment issue than it is a Second Amendment one, gun owners were enraged.

Joshua Cook tells us in an exclusive interview that he received a phone call from the Spartanburg, SC District 1 superintendent Dr. Ron GarnerAccording to Cook, Dr. Garner called him at work and demanded he retract the story. Abrupt and yelling, Dr. Garner threatened Cook that lawyers were now involved in the case.

“I just don’t understand how he got all my information. He told me where I went to College and the town I grew up in. He had been monitoring my social media sites too. He called me at work also, which was strange. How did he know I worked at this office? When I asked him where the teacher got the curriculum he refused to answer,” says Cook.


*UPDATE: Since the publication of this article the student now says that she was lying about the teacher changing the answer.

    Am I the only one who sees the fallacy in this article? Look at the picture of the worksheet!!! No one is arguing or commenting on the real question at hand. The picture below is supposedly the girls paper (it is irrelevant who changed the answer). The question does NOT say is it constitutional for the cops to confiscate the gun…it says that the cops confiscated the gun, period. Then the worksheet asks, Is this situation Constitutional? answer: YES, b/c of the second amendment. If the girl had answered, No, then she was incorrect.

    The cops did not have the right to confiscate the gun at a traffic stop, when the gentleman stopped had a license. THERE IS NO CASE HERE. Nothing is wrong with what the teacher said according to the picture of the worksheet. I’m not sure why people are arguing about this. The question is clear, assuming (and I am) the man was not deranged in some way. There is no fuss. I really am ashamed of Ben Swann and Joshua Cook for such shoddy reporting. Did they not read the question? Did the parents not read the question? This is the real problem with today’s education system. People need to learn to READ, sheesh!

    If they take away our 2nd Amendment rights and without our guns as protection, this tyrannical government will go after our 1st Amendment right to free speech. Does anyone out there see a pattern here? If you don’t perhaps more attention needs to be paid by all.

    LegalEagle you’re an idiot! Clearly you don’t comprehend the Constitution, in part yes…fully no. The God given right of defending one’s self, family and property cannot be taken away by man. The 2nd Amendment is in fact first and foremost as you stated about self defense against a tyrannical government as in the Obama administration. The secondary right is self defense, period. It is not within your power or the power of the government to restrict our right to self defense. The right to own a gun is in fact given to every single American and that right cannot be infringed upon. Our 2nd Amendment right has been infringed upon since 1934, enough is enough!

    The Constitution was written in such a way for all men to easily understand and comprehend, it’s simple and straight forward and needs NO interpretation! Especially by lawyers who never seem to get it right! Their ignorance is understandable though, when taking into consideration the their so called “Higher Education” liberal indoctrination. Every single illegal gun law that has been put in place since 1934 must be removed, we’re not asking we’re telling!

    Right to keep and bear arms shall not be infringed! What part of Right and shall not be infringed do you not understand Legal Eagle? I have the right to survive, not the right to live. Part of surviving is the ability to defend myself. I think this is where anti-gun people are mistaken. They actually believe they have the right to live and somehow guns pose a threat to that false “right”. I am sure the zebras in the wild would love to have the right to live. The reality for all is there is no right or guarantee to live. The Constitution protects the right for us to survive the lions of the world.

    It would appear that the teacher does not know the answer based on Constitutional Amendments 2, 4, and 5. It appears the Superintendent does not know no that the First Amendment of said Constitution protects both free speech and a free press. None of this is the least bit surprising. The left wing Common Core standards are designed to deal a death blow to the rights of the individual in favor of the rights of the group. The problem with this, other than the obvious conflict with the US Constitution, is that the smallest minority of all is the individual. So much for minority rights.

    There’s no such thing is this country as a total and complete right in this country and you know it. You also have the right to privacy but not when it comes to wiretaps, searches of your vehicle or person, etc. Just because Americans have a right to weapons does not mean every American has a right to any weapon at any time. And btw, as the language of the 2nd amendment states, the purpose of having those weapons was meant to be a safety for protection against a tyrannical government – not an excuse to shoot other citizens and get away with it.

    what this article brings to light is that in our schools today, there is a flamboyant attempt to indoctrinate our children with leftist propaganda. that is the point you should have taken from this article.

    Idiots it sounds like and I am a retired teacher. The teacher was not teaching, she was just following an answer key. The teacher was not telling a lie, she just had no idea how ignorant the question was and as is a habit of most teacher, she put in what the answer key had. It is called being lazy. The headline was very misleading so the whole article was a sham from beginning to end.

    First, the question is totally insanely written. Not enough information given to even guess at yes or no. Secondly What was reason for traffic stop, was there reasonable cause for a stop? or, did the guy appear out of control, angry, had a crime been committed, or was this just a poorly stated question? If this is how this teacher writes questions, she/he needs a short course in how to write test questions. Somehow this whole thing appears to be a lesson in Where the heck is the rest of the question?
